Agreement for Providing Services
This Public Offer contains the terms and conditions for the conclusion of a Service Agreement (hereinafter referred to as the “Agreement”).
This Offer shall be deemed a proposal addressed to one or more specific persons, which is sufficiently definite and expresses the intention of the person making the proposal to consider themselves as having entered into the Agreement with the addressee who accepts the proposal.
The performance of the actions specified in this Offer shall constitute confirmation of the consent of both Parties to conclude the Agreement on the terms, in the manner, and to the extent set forth herein.
The text of this Public Offer below constitutes the official public proposal of the Service Provider, addressed to an indefinite circle of persons, to conclude the Agreement in accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation.
The Service Agreement shall be deemed concluded and shall enter into force from the moment the Parties perform the actions stipulated in this Offer.
Terms and definitions:
Agreement – the text of this Offer, together with all parts and appendices constituting an integral part hereof, accepted by the Customer through the performance of the conclusive actions stipulated by this Offer.
Conclusive Actions – conduct that signifies the Customer’s consent to the proposal of the Service Provider to enter into the Agreement. Such actions consist of full or partial performance of the conditions proposed by the Service Provider.
Parties to the Agreement (the Parties) – the Contractor and the Customer.
HW Goodwin Script – a set of computer programs forming part of an information system accessible via the Internet at the following domain name(s) and network address(es):
Tariff Plan – a set of access rights within the HW Goodwin Script to the corresponding functionality. The description of such functionality is provided on the Developer’s website: https://goodwin.best/plans
Activation Period – the number of calendar days corresponding to the continuous period during which access is granted to the Customer in accordance with the selected Tariff Plan.
Service – the provision of access to the HW Goodwin Script by the Service Provider to the Customer in accordance with the selected Tariff Plan and Activation Period, and under the terms and conditions established by this Offer.
2.1. The Contractor undertakes to provide the Customer with access to one of the tariff plans of the HW Goodwin script, and the Customer undertakes to pay for it in the amount, manner, and within the time limits established in the description of the relevant Tariff Plan.
2.2. The name, Activation Period, procedure, and other conditions for the provision of Services are determined based on the Contractor’s information in the description of the service selected by the Customer or established on the Contractor’s website on the Internet: https://goodwin.best/purchase
2.3. The Agreement is concluded by acceptance of this Offer through the performance of conclusive actions expressed in:

3.1. Rights and Obligations of the Contractor
3.1.1. The Contractor undertakes to provide the Customer with access to the selected Tariff Plan and to render the Services in accordance with the provisions of this Agreement, within the time frame and scope specified in the description of the purchased Tariff Plan.
3.1.2. The Contractor undertakes to provide the Customer with access to the functions of the HW Goodwin script specified in the description of the relevant tariff plan on the website: https://goodwin.best/plans
3.1.3. The Contractor is responsible for storing and processing the Customer’s personal data, ensures the confidentiality of such data, and uses it exclusively for the purpose of providing high-quality Services to the Customer. The Contractor does not disclose users’ personal data, including their gaming SNID, to third parties, including representatives of the company Nexters Global Limited.
3.1.4. The Contractor reserves the right to change the terms (period) of service provision and the conditions of this Offer unilaterally without prior notice to the Customer by publishing the relevant changes on the Contractor’s website on the Internet. At the same time, new or amended terms indicated on the Website apply only to newly concluded Agreements.
3.2. Rights and Obligations of the Customer
3.2.1. The Customer must provide accurate personal information when receiving the relevant Services.
3.2.2. The Customer undertakes not to sell or use for any purposes the information and materials made available to them in connection with the provision of the Services, except for personal use by the Customer without providing access to any third parties in any form.
3.2.3. The Customer undertakes to accept the Services rendered by the Contractor.
3.2.4. The Customer guarantees that all terms of the Agreement are clear to them; the Customer accepts the terms unconditionally and in full.
4.1. The cost of the Contractor’s services provided to the Customer and the payment procedure are determined based on the Contractor’s information when the Customer submits an application or are established on the Contractor’s website: https://goodwin.best/purchase
4.2. All payments under the Agreement are cashless.
5.1. In case of non-performance and/or improper performance of obligations under the Agreement, the Parties shall be liable in accordance with the terms of this Offer.
5.2. The Contractor shall not be liable for non-performance and/or improper performance of obligations under the Agreement if such non-performance occurred due to the fault of the Customer.
5.3. The Contractor has no relation to the company Nexters Global Limited and does not influence the Customer’s account in any way. The Contractor shall not be liable for the loss or blocking of the account for any reason, including due to the use of the HW Goodwin script.
5.4. The Contractor shall not be liable for temporary loss of access due to local blocking of hosting mirrors specified in the Terms and Definitions section as a result of actions by the Customer’s internet provider. In this case, the loss of access does not imply compensation.
6.1. This Offer enters into force from the moment it is posted on the Contractor’s Website and remains valid until it is withdrawn by the Contractor.
6.2. The Contractor reserves the right to amend the terms of the Offer and/or withdraw the Offer at any time at their own discretion. Information about amendments or withdrawal of the Offer shall be communicated to the Customer at the Contractor’s discretion by posting it on the Contractor’s website, in the Customer’s personal account, or by sending a notification to the email or postal address specified by the Customer when concluding or performing the Agreement.
6.3. The Agreement enters into force from the moment the Customer accepts the terms of the Offer and remains valid until the Parties fully fulfill their obligations.
6.4. Amendments made by the Contractor to the Agreement and published on the website in the form of an updated Offer shall be considered accepted by the Customer in full.
6.5. The Parties have determined that the language of the Agreement concluded under this Offer, as well as the language used in any interaction between the Parties (including correspondence, request submission/notifications/explanations, documents provision, etc.), shall be English.
